1. Usurpation of Authority
Under Article 177 of the Revised Penal Code, usurpation of official functions is committed by any person who performs any act pertaining to a public officer under pretense of official position without being lawfully entitled to do so. Performing a marriage ceremony without statutory authority constitutes usurpation of official functions. The law strictly penalizes unauthorized individuals who exercise functions exclusively vested in public officers, as such acts undermine public order and civil registry records.

2. Falsification by Officer
Under Article 171, paragraph 2 of the Revised Penal Code, a public officer commits falsification of a public document by taking advantage of his official position to cause it to appear that persons participated in an act or proceeding when they did not in fact participate. When a public official signs a marriage certificate falsely attesting that he personally solemnized a marriage ceremony when he was absent, he commits falsification by taking advantage of his official position.

3. Marriage Solemnization Rules
Under the Family Code of the Philippines, city and municipal mayors possess statutory authority to solemnize marriages within their territorial jurisdiction. However, this authority is personal to the elected official and cannot be delegated to subordinate staff members. Any marriage solemnized by an unauthorized person is void ab initio for lack of authority in the solemnizing officer, and falsely certifying performance of the ceremony in an official registry violates public faith.
