1. Concept of Usufruct
Under Article 562 of the Civil Code, usufruct gives a right to enjoy the property of another with the obligation of preserving its form and substance, unless the title constituting it or the law otherwise provides. Usufruct is a real right that confers the right to use and the right to enjoy the fruits of the property. However, ownership remains with the naked owner, and the usufructuary is obliged to maintain and preserve the property throughout the duration of the usufruct.
2. Usufructuary Useful Improvements
Under Article 579 of the Civil Code, a usufructuary may make on the property held in usufruct such useful improvements or expenses for mere pleasure as he may deem proper, provided he does not alter its form or substance. However, the usufructuary has no right to be indemnified for these improvements. His sole right upon the termination of the usufruct is to remove such improvements, provided it is possible to do so without causing damage to the property.
3. Set-off of Improvements
Under Article 580 of the Civil Code, the usufructuary may set off the improvements he may have made on the property against any damage caused to the same. While the usufructuary cannot demand monetary reimbursement from the naked owner for useful improvements, Article 580 grants him a limited equitable remedy. If the usufructuary caused damage to the property during the usufruct, he may offset the value of his useful improvements against his liability for damages.
