1. Transmission of Succession
Under Article 777 of the Civil Code, the rights to the succession are transmitted from the moment of the death of the decedent. Successional rights, including the ownership of the decedent's property, vest automatically in the compulsory or legal heirs by operation of law at the exact instant of death. Consequently, legal heirs immediately acquire co-ownership rights over the estate and possess the legal personality to institute civil actions to defend, protect, or recover estate properties without needing prior judicial intervention or court confirmation.

2. Declaration of Heirship
While special proceedings under Rule 90 of the Rules of Court generally govern the settlement of estates and the formal declaration of heirship, recent jurisprudence clarifies that a prior judicial declaration of heirship is not a mandatory prerequisite for legal heirs to enforce their successional ownership rights. Where no special proceeding for settlement of the estate is pending, legal heirs may directly assert their ownership rights in an ordinary civil action, such as an action for reconveyance, quiet of title, or recovery of possession.

3. Exception to Exclusivity
The rule requiring a special proceeding for declaring heirship applies strictly when there are contested claims among competing heirs or when the administration and settlement of estate debts are necessary. However, where an ordinary civil action aims primarily to protect or recover real property belonging to the estate from third-party usurpers, requiring a separate special proceeding would cause unnecessary delay and injustice. In such cases, the trial court in the ordinary civil action may make a preliminary determination of heirship solely for resolving property ownership.
