2022 Civil Law, Q24

Gio, single, joined a marathon organized by Takbo Co. For lack of alternative routes, the marathon course included a public road which was not blocked-off from vehicles. Takbo Co. solicited the sponsorship of Kotse Corp. for added financial support. Gio was hit by a jeepney driven by JD on the public road and died. The parents of Gio sued Takbo Co. and Kotse Corp. for damages. The court ruled that Kotse Corp. is solidarily liable for damages with Takbo Co. for being one of the principal movers of the event due to its sponsorship. Is the court correct? Explain briefly. 1. Quasi-Delict Proximate Cause
Under Article 2176 of the Civil Code, a quasi-delict requires a fault or negligent act or omission that serves as the direct, efficient, and proximate cause of the injury sustained. Proximate cause is defined as that cause which, in natural and continuous sequence, unbroken by any efficient intervening cause, produces the injury, and without which the result would not have occurred. For a party to be held civilly liable for damages in a quasi-delict action, its conduct must be shown to have directly caused or materially contributed to the harmful event.

2. Corporate Sponsor Liability
Mere financial sponsorship of an event or athletic activity does not generate legal liability for quasi-delict or personal injury. A corporate sponsor that provides funds, advertising, or financial support without exercising operational control, route selection, management, or safety supervision over the activity cannot be held liable for injuries arising during the event. Financial sponsorship is legally remote from the operational negligence of event organizers or third-party vehicle drivers, failing to establish the requisite causation link necessary for solidary damage liability.

3. Solidary Tort Liability
Under Article 2194 of the Civil Code, responsibility for quasi-delict is solidary when two or more persons are joint tortfeasors who jointly contribute to a single injury through concurrent negligent acts. However, solidary liability cannot be imposed on an entity that committed no tortious or negligent act. Where a corporate sponsor lacks direct participation in or control over safety protocols and traffic management, it cannot be categorized as a joint tortfeasor with the event organizer or the negligent driver.
