2023 Civil Law, Q13

Felicia and Rocky met at a training convention and subsequently became lovers. They had children named Enrico and Euriz. One night while on his way home, Rocky met his end when his car collided with a speeding 15-wheeler truck along C-5 Road. A year later, the father of Rocky, Hilario, suffered a brain aneurysm and died. In the settlement of the estate of Hilario, Enrico and Euriz claimed an interest in the estate of their grandfather. They argued that as the biological children of Rocky, they are entitled to inherit from their grandparents by right of representation. The legitimate heirs of Hilario vehemently opposed the claim on the ground that Enrico and Euriz are barred from inheriting from the ascendants of Rocky. Are the legitimate heirs of Hilario correct? Explain your answer.

1. Right of Representation
Under Article 970 of the Civil Code, representation is a right created by operation of law by virtue of which the representative is raised to the place and the degree of the person represented, acquiring the rights which the latter would have if living or if qualified to inherit. Under Article 982, grandchildren and other descendants inherit by right of representation whenever all the children of the deceased die before the decedent or are incapacitated. Representation allows descendants to step directly into the inheritance rights of their predeceased parent in the grandparent's estate.

2. Aquino v Aquino
In the landmark case of Aquino v. Aquino, the Supreme Court reinterpreted Article 982 in harmony with the constitutional mandate to protect all children. The Court ruled that children, regardless of whether born in or out of wedlock, possess the right to inherit from their direct ascendants by right of representation. Nonmarital children can represent their predeceased biological parent in the estate of their grandparent. This ruling eliminated the discriminatory distinction that previously barred nonmarital descendants from representing their parent in legitimate direct ascendants' estates.

3. Iron Curtain Rule
Article 992 of the Civil Code, historically known as the iron curtain rule, prohibits intestate succession between nonmarital children and the legitimate relatives of their parents. In Aquino v. Aquino, the Supreme Court clarified that Article 992 does not create an absolute bar against representation under Article 982. The iron curtain rule applies strictly to collateral relatives and does not prevent nonmarital grandchildren from representing their biological parent in inheriting from direct line grandparents, thereby ensuring equal treatment of descendants in the direct line.
