1. Unaccepted Resignation Effect
Under Philippine labor law and settled jurisprudence (Clemente v. Eso-Nice Transport Corp.), a tender of resignation that is not accepted by the employer does not sever the employment relationship. Resignation is a formal notification that requires acceptance or effective acknowledgment to take effect. When an employer refuses or fails to accept a worker's resignation and subsequently issues a formal termination notice, it is the employer's act of dismissal that severs employment. Consequently, the employer cannot later defend against an illegal dismissal suit by claiming voluntary resignation.

2. Employer Burden Proof
In illegal dismissal cases, Article 292(b) of the Labor Code establishes that the burden of proving that the termination was for a valid or just cause rests squarely on the employer. The employer must discharge this evidentiary burden by adducing substantial evidence—that amount of relevant evidence which a reasonable mind might accept as adequate to justify a conclusion. If the employer fails to prove just cause by substantial evidence, the dismissal is legally declared unjustified and illegal per se.

3. Criminal Charge Impact
The mere filing of an administrative audit report or a criminal complaint against an employee does not automatically establish just cause for termination under Article 297 of the Labor Code. Criminal liability requires proof beyond reasonable doubt, whereas labor termination requires substantial evidence of personal culpability. An employer cannot rely solely on an unproven criminal charge or general audit shortage without presenting specific, concrete evidence demonstrating the employee's direct participation in the financial anomaly or breach of trust.
