1. Union Affiliation Exception
Under Article 255 of the Labor Code, as amended by Republic Act No. 9481, supervisory employees cannot join a labor organization of rank-and-file employees. However, the law provides a specific exception permitting rank-and-file unions and supervisory unions operating within the same establishment to affiliate with the same federation or national union. This statutory rule recognizes that when both local unions belong to the same employer establishment, commingling concerns are mitigated by common bargaining context, allowing co-affiliation with a single parent federation.

2. Inter-Establishment Affiliation Rule
The statutory exception under Article 255 permitting co-affiliation of rank-and-file and supervisory unions applies strictly to locals operating within the same establishment. Rank-and-file unions and supervisory unions from different establishments are legally prohibited from joining the same federation. Affiliations crossing establishment lines risk undue influence, conflict of interest, and structural commingling between supervisors and rank-and-file workers across independent business enterprises. Consequently, a federation cannot lawfully accept supervisory and rank-and-file affiliate locals coming from different employer entities.

3. Federation Registration Standard
Under Article 241 of the Labor Code, an application for federation registration requires proof of affiliation of at least ten legitimate local unions, each of which must be a recognized bargaining agent in its respective establishment. When member unions are legally disqualified from co-existing within the same federation due to prohibited inter-establishment commingling, those disqualified locals cannot be counted toward the statutory ten-affiliate threshold. If deducting disqualified local unions reduces the total legitimate affiliates below ten, the application for federation registration must be denied.
