1. Constructive Dismissal
Constructive dismissal occurs when an employer creates an unbearable work environment through clear disdain, insensibility, or severe verbal humiliation that compels an employee to resign. Although framed as a voluntary resignation, the law treats the departure as an involuntary dismissal because the worker is forced to yield to intolerable working conditions. The test is whether a reasonable person in the employee's position would feel compelled to give up their employment. Once constructive dismissal is established, the employee becomes entitled to full backwages and reinstatement or separation pay.

2. Serious Insult Resignation
Under Article 300(b) of the Labor Code, an employee may immediately terminate the employment relationship without serving a thirty-day prior notice if the employer or their representative commits a serious insult on the honor and person of the employee. Repeated verbal public humiliation by an employer directly attacks the worker's dignity and honor. When an employee quits under these degrading conditions, the resignation is legally justified and involuntary, preventing the employer from claiming that the worker voluntarily abandoned employment.

3. Illegal Dismissal Reliefs
An employee who is constructively dismissed is legally considered illegally dismissed and is entitled to statutory remedies under Article 294 of the Labor Code. Primary reliefs include reinstatement to the former position without loss of seniority rights and full backwages computed from the time of constructive dismissal until actual reinstatement. If reinstatement is no longer feasible due to strained relations or hostile working conditions created by the employer's conduct, separation pay equivalent to one month salary for every year of service is awarded instead.
