1. Territoriality of Taxation
Under the inherent territorial limitation on taxation, a sovereign state can only exercise taxing power over persons, property, and business operations located within its territorial jurisdiction. Extending tax jurisdiction over real property situated beyond national boundaries violates international law and fundamental principles of state sovereignty. While a state may exercise personal jurisdiction over its citizens regarding worldwide income, real property taxation is strictly territorial. Consequently, any statutory enactment attempting to levy real property taxes on land situated in a foreign country is unconstitutional and void for lack of jurisdiction.

2. Situs of Taxation
The situs of real property tax is determined by the physical location of the immovable property under the legal principle of lex rei sitae. Real property is exclusively subject to the taxing authority of the jurisdiction where it is physically located, as that state provides the police protection, infrastructure, and legal security for the property. Unlike income taxation, where citizenship or residence can serve as a nexus, real property taxation requires a physical presence within the territory. Citizenship alone cannot create tax jurisdiction over foreign real estate.

3. Lex Rei Sitae
The doctrine of lex rei sitae dictates that real property is governed by the law of the place where it is situated. In taxation law, this doctrine establishes that only the sovereign state having physical control over the land can validly assess and collect property taxes thereon. A sovereign state cannot enforce tax liens or execute tax sales against real estate located in another independent nation. Therefore, Philippine tax laws cannot reach real property situated in foreign countries regardless of the owner's Philippine citizenship.
