1. Spousal Insurable Interest
Under Section 10(a) of the Insurance Code, a person possesses an insurable interest in the life and health of their spouse. Insurable interest in life insurance exists when there is a legal relation of love and affection or a pecuniary interest between the policyholder and the insured. Unlike property insurance, which requires insurable interest both at inception and at the time of loss, life insurance requires insurable interest only when the policy takes effect under Section 19. Consequently, an individual may validly procure a policy on the life of their legal spouse based on their marital relationship.
2. Legal Separation
A decree of legal separation under Article 63 of the Family Code entitles spouses to live separately and dissolves their conjugal partnership or absolute community property, but it does not sever the legal bond of marriage. Because legal separation leaves the marital tie intact, the parties remain lawfully married as husband and wife under Philippine law. Therefore, a legally separated spouse continues to possess a valid insurable interest in the life of the other spouse under Section 10(a) of the Insurance Code, as their legal status as married spouses persists despite the court decree.
3. Timing of Interest
Under Section 19 of the Insurance Code, an insurable interest in life or health must exist when the insurance takes effect, but need not exist thereafter or when the loss occurs. This rule distinguishes life insurance from property indemnity contracts. Once a life insurance policy validly attaches due to an existing insurable interest at inception, any subsequent termination or change in the underlying relationship does not void the contract or bar recovery. The insurer remains obligated to pay the proceeds upon the death of the insured, provided insurable interest was present at policy issuance.
